Matrimonial property system

The matrimonial property system concerns the agreements that apply between spouses or persons who have concluded a cohabitation contract with each other concerning the entitlement to possessions and income, such as community of property and prenuptial agreements.

In 2018, the new matrimonial property law came into force. As a result, any property and debts that the spouses had before the marriage remain private. Only what spouses acquire during their marriage becomes common and must be shared or divided at the end of the marriage.

The best matrimonial property system for your situation depends on various aspects of civil law, such as separating business assets to secure private assets for creditors of one's company, but also on tax aspects, such as the consequences in the event of death or possible divorce.
